A CP161 says you have an unpaid balance, and the notice explains how the IRS calculated it. source 1
The IRS page mentions both late payment and failure-to-deposit penalties, so it can reach employers as well as individuals. source 1
Because the math is on the page, we check it line by line against the return and the payment list before anything else.
The date that counts
Pay the amount due by the date on the notice. If you think the IRS made a mistake, the IRS page asks you to contact it within a set number of days from the date of the notice, which the notice prints. source 1
Why people get one
- A return showed more tax than was paid.
- A payment or deposit wasn't counted, or was applied somewhere else.
- A penalty or interest was added to the account.
First steps
- Compare the figures on the notice with your return. source 1
- Check the list of payments the IRS applied to see whether all of yours were counted. source 1
- Check your IRS online account (typed in yourself at irs.gov) to confirm the notice is real and see the balance and any payments already posted.
- If you think there's a mistake, call the number printed on your notice promptly, with records such as canceled checks. source 1
- If the amount is right, pay by the date on the notice, or call to arrange payment if you can't pay it all. source 1
What not to do
- Don't wait to raise a mistake. The window to contact the IRS about an error is short. source 1
- Don't pay through a link or phone number from an unexpected email or text. Use irs.gov, typed in yourself.
- Don't pay late if you can avoid it. The IRS says no added interest is charged if the full amount is paid by the due date. source 1
