What a CP59 means

A CP59 says the IRS has no record that you filed your prior-year personal return. source 1

The IRS wants one of two things: the return, or a reason you didn't need to file. source 1

If you owe, the IRS says penalties and interest keep adding up until you file and pay in full. If you're owed a refund, strict time limits apply. Either way, waiting costs something. source 1

The date that counts

The IRS says to file right away, or tell it why you don't need to. If you filed recently, within a period it gives on its page, it says you don't need to do anything. source 1

Why people get one

  • The return was never filed.
  • It was filed recently and hasn't posted yet.
  • An e-filed return was rejected and never resubmitted.
  • The name, SSN or tax year on what you filed didn't match the IRS's records.

First steps

  1. Check whether you filed for the year on the notice, and whether an e-filed return was rejected. source 1
  2. Check your IRS online account, typed in yourself at irs.gov, for what's on record.
  3. If you haven't filed, file now. Include your IP PIN if you have one, and each spouse's on a joint return. source 1
  4. If you filed a while ago, confirm the name, SSN and year match, then mail a signed, dated copy. source 1
  5. If you believe you didn't need to file, the IRS points to Form 15103. source 1
  6. If you can't pay what the return shows, request a payment plan. source 1

What not to do

  • Don't wait for a second letter. Penalties and interest keep running on any balance. source 1
  • Don't ignore it because you're owed a refund; refunds have strict time limits. source 1
  • Don't pay or file through a link in an unexpected email or text. Use irs.gov, typed in yourself.

  • Related CP80 The notice that payments sit on an account with no return filed.

Questions

What if I disagree with a CP59?

The IRS says to file Form 15103 by mail or fax if you believe it made a mistake. source 1

I already filed. Why did I get a CP59?

If you filed recently, the IRS says you don't need to do anything. If it's been longer, check the name, SSN and year match, mail a signed, dated copy, and confirm the return wasn't rejected. source 1

Can I e-file a past-year return after a CP59?

The IRS says it accepts electronic returns for the last two years through an e-file provider, though not every provider offers it. source 1
